✦ Prices shown are just the base rate and is subject to rise depending on how complex the character will be drawn/the design of the character (eg. wings, horns, tails, tattoos, accessories, etc.)✦ Background base rates starts at 30$+ and will rise depending on the complexity of the background. NOTE! I am still not good with backgrounds and can only do simple ones.

[ Terms of Service ]

✦ By purchasing my services and placing an order, you agree that you have read and accepted all the following terms and conditions described. The client will be held responsible for failure to read the terms of service.✦ You will agree here to the policy of using the art for personal, non-profit purposes unless otherwise stated (more information on commercialization and licensing rights are stated below).✦ You shall not use nor instruct a third party to use the commissioned work for NFTs, AI art websites, art stealing programs, blockchains and any other platforms that would disparage or degrade the moral rights of the Artist.✦ Breach of the terms of service will result in being blacklisted from my services indefinitely and without warning.✦ If you have any questions, please contact me through email.


Client:

The client is expected to first read the TOS and understand my general commission prices.✦ First come, first serve basis.✦ Each commissioned work is recognised as one slot.
- A slot is a spot given to a client who availed for the artist’s commission service.
- Each slot is in a certain order of an artist’s waitlist/queue.
✦ Whenever the client or a third party instructed by the client, publicly displays the commissioned work, the Artist shall be credited to the effect that the Artist will be recognized by a reasonable person.✦ There is no need to ask for permission to post the commissioned artwork on other socials.✦ May NOT claim the artist’s work as your own nor upload/host my work in a gallery that is intended to display your own work only (especially without credit).✦ Is NOT authorized to change, modify, or edit my works without permission.✦ Is NOT authorized to crop out any signatures placed.✦ Is NOT authorized to trace over or heavily reference my art in any way, including the use of the artwork as a “base”.✦ Any harassment in an attempt to bargain for a commission slot or to complain about my work speed is not tolerated. Other rude, inappropriate, inflammatory, and/or non-constructive comments on my profile and private messages will result in blacklisting.✦ The Client’s obligations under the ToS persists even after the termination or completion of the service.Client’s Rights & Personal Use:✦ If the Client plans on using the commissioned piece for commercial use, it must be discussed and signed as a contractual agreement with the artist. The price of a commissioned work for commercial/monetized use is commensurate to the base price if it were recognized for personal use.✦ The Client may only use the commissioned artwork for personal use (displaying on social media accounts with no direct or indirect monetization or profit).✦ May use the commissioned art for profile pictures, banners, and posts; phone or computer wallpapers; print and framing in personal spaces; and etc.✦ May use it as a gift for someone.✦ The Client may display the commissioned work to a third party for the third party’s personal use. The Client shall not instruct the third party any actions that would otherwise be a breach of the TOS shall it be conducted by the Client.✦ Reserve the right to print or create an otherwise physical reproduction of the artwork as long as it's for PERSONAL & NON-PROFITABLE use only (i.e. not for sale or redistribution).Client’s Digital Copy of the Commissioned Piece:✦ The client is responsible for saving any image, digital data or information related to the commission that I provide.✦ Any file paid for is only available for a finite time only. Measures will be taken to preserve most files for up to 3 months. However there is no guarantee against any technical failures, accidental deletions or loss of the file after the final file of the commissioned piece was sent to the client.The final file is defined as the high-quality image file of the commissioned work without any heavy watermarks.


Artist:

✦ By commissioning me, the client acknowledges that I retain full usage, rights, and ownership of the commissioned piece. I retain the right to post, sell, print, display, or otherwise use the commission product, unless previously discussed.✦ I reserve the right to refuse a commission request if unable to fulfill your request and to decline any project or client for any reason.✦ I reserve the right to post the finished artwork in my gallery or socials unless requested not to. However, giant watermarks would be applied to make the clear image accessible by the client only.✦ I reserve the rights to use the finished commissioned work as a part of my portfolio, as stated in the agreement signed by both parties.✦ I, the Artist, reserves full exclusive rights vested upon Intellectual Property ownership with the exception of exclusive rights to public display of the original or copy of the commissioned work.✦ The governing laws for Intellectual Property shall be the provisions stated under the World Intellectual Property Organization with the exception to alterations or modifications made under the ToS.✦ I reserve the right to reject critiques pertaining to artistic skill & stylization. The client must respect that my art style cannot be altered.Artist Rights:
✦ I retain the following exclusive Intellectual Property rights, unless otherwise agreed upon:
- reproduction of the commissioned work in various forms, such as printed publications or digital files;
- distribution of copies of the commissioned work;
- public performance of the commissioned work;
- broadcasting or other communication of the commissioned work to the public; and
- making the commissioned work available on the internet for on-demand access by the public.


Queue/Deadlines

✦ I usually take 2-5 business days to respond to the initial order inquiry.
✦ There is NO binding deadline unless previously agreed upon and disclosed prior to payment.
✦ The artist has a right to decline a project if the deadline/time allowance is too short.
✦ The artist has the right to take up to 2 weeks to begin work on the project after payment.
✦ All commissions will have an expected time of within 4 months to complete unless I inform the commissioner beforehand (inclusive of queue). The client will be notified of any delays.
✦ Depending on the circumstance, if the Artist feels like the commission would take longer than the predetermined time period, the Artist shall provide an updated timeline of the commission of the work.

Payments, Refunds & other fees

✦ The payment is to be accomplished upfront before production begins, from the Client to Artist.✦ Other payment plans (i.e. downpayment) may be applicable for some projects. Please inquire for more details.✦ An invoice will only be sent once the agreement is finalized via email/DM.✦ The following are the only available payment methods (in USD):
Paypal Invoice (International)
✦ The verification of the payment transaction of the Client shall be done before the Artist commences the Agreement.✦ The final file of the commissioned piece will be sent once the payment is 100% completed.✦ Tips are very much appreciated but wouldn’t be necessary. Thank you so much if you do!Refunds
✦ Once payment has been made, the artist does NOT issue any refunds unless otherwise agreed upon.
✦ 100% of the refund is only available if the artist has not started working on the draft or sketch yet.✦ The artist reserve the right to revoke a commission request at any time based on schedule or unexpected events. A refund will be offered in this case commensurate to work not yet made.✦ Purposeful issuing of chargebacks without contacting the artist to terminate/refund a project will result in immediate blacklisting.✦ The agreement for a commission may be terminated if payment has not been made yet after one calendar month or 31 days after the agreed upon payment date, unless indicated otherwise.✦ In cases where payments are stated to be done upfront, the client has 48 hours after confirmation and sending of invoice to complete the transaction.✦ Non-compliance with the agreed upon payment schedule shall constitute a breach of the Agreement and shall entitle the Artist to terminate the Agreement on their own volition. Moreover, non-compliance with the agreed upon payment schedule entitles the Artist to all work already made, completed or both pursuant to the Agreement.✦ Willful Termination:
- The termination of the Agreement made by either party shall entitle the Artist payment on work already made, completed or both, that was made pursuant to the Agreement.
- Upon payment of work made, completed or both, the Artist shall surrender to the Client all the work and purchases made under this Agreement, including but not limited to, information, illustrations, designs, materials, and any other property provided by or specifically funded by the Client.- However, the Artist retains full Intellectual Property rights, including copyright, to all preliminary works, sketches, and drafts. These materials are provided for the Client’s review only.- In the event of a client initiated termination of the Agreement, the Client shall neither communicate nor instruct a third party to communicate to another artist any drafts or unfinished content to be used as reference for production or execution. This specifically prohibits the Client from finishing the work themselves or hiring a third party to "trace," complete, or create derivative works based on the Artist’s preliminary sketches and drafts without explicit written permission.✦ The client is required to contact the artist if a commission request is to be terminated.Rush Fees
✦ Rush fees are at least +25% of the commission. Fees might vary depending on the project and the timeframe provided.
✦ In some cases, rush commissions could bring your queue up forward significantly.✦ Details are to be discussed should the client have set dates for rush commissions.

Revisions

✦ Draft submissions / WIPs (‘work in progress’) is only applicable after the payment is completed, depending on the agreed payment plan.✦ A typical round of “revision” will start after draft submission.✦ The client has 3 days to give feedback. Once all comments, ideas, and questions have been consolidated, the artist will submit a new iteration of the work and conclude the production phase’s round. If no feedback is received within 3 days, the artist reserves the right to assume approval and move forward to the next phase, or pause the commission until the client responds.✦ The artist allows 1 (one) Major Revision Round and 3 (three) Minor Revision Rounds on the Conceptualization Phase, free of charge. The artist is not responsible for any unsatisfactory element/s of the finished design if no feedback was given to amend it during this phase.✦ Phases of the Commissioned PieceConceptualization Phase:
Draft --> Sketch --> Color Sketch
Production Phase:
Lineart & Base Colors --> Rendering
✦ Explicit confirmation is required before moving to the Production Phase.✦ The client will be subjected to the following fees for any extra revisions on the character or subject:Extra Revision Round Cost during Conceptualization Phase:
Major - 15% of base price
Minor - 5% of base price
Extra Revision Round Cost during Production: Lineart and Base Colors
Major - 50% of base price
Minor - 20% of base price
Extra Revision Round Cost during Production: Render

Minor - 30% of base price
✦ The artist will not be required to redraw a completed commission unless a payment is received for a second order/slot.
